The Federal Criminal Police Office (BKA) in Berlin, Germany, could be granted new sweeping powers by Federal Ministry of the Interior Nancy Faeser to allow the police to discreetly enter and search private residences and apartments for the purpose of snooping on computers and other mobile devices of suspected criminals, in an supposed bid to better combat terrorism.

German paper Der Spiegel obtained a draft of the law, which said ‘the BKA law contains the “authority to conceal apartments,” for example to install espionage software on computers or smartphones, and the authority to “concealed search of apartments.” However, these instruments should only be able to be used under very high hurdles, as a last resort and only for combating terrorism,’ the paper reported.

Moreover, ASB Zeitung explained that ‘BKA has a central role in criminal prosecution and in combating the dangers of international terrorism. According to Faeser, it needs modern instruments in the analog and digital worlds, as reported by the RND from security circles. The Federal Ministry of the Interior is currently drafting a bill to reform the BKA law. However, the secret search of apartments should only be possible under very high thresholds as a last resort, the RND reported.’

German outlet Heise also pointed out that ‘the aim could also be to replace possible “means of crime” before planned attacks or to render them unusable.’

A spokesperson from the ministry in Berlin told Der Spiegel that the BKA has “as the central office of the police authorities in Germany a central position in law enforcement and countering the dangers of international terrorism.” He added that he specifically referred to the threats presented by Islamic terrorism. “In our view, it is completely self-evident that the security authorities must have the appropriate powers to deal with this,” he explained.

However, the spokesperson said that the legislative plans are “still in very early intergovernmental consultations.”

Konstantin von Notz, the deputy chairman of the Green Party’s parliamentary group, spoke of “serious times” to the RND, saying the BKA requires “modern investigative powers and means.” Meanwhile, it is “completely clear that these powers can only be granted within the framework of the constitutional order,” he said.
