John Roberts led the majority, alongside justices Sonia Sotomayor, Elena Kagan, Ketanji Brown Jackson, and Amy Coney Barrett. Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh dissented.

A divided US Supreme Court said the Biden administration can remove parts of a fence along the southern border built by Texas to try to stem illegal immigration.
In an order on Monday, the justices vacated a December ruling by the US Court of Appeals for the Fifth Circuit that said the US Border Patrol could only cut down razor wire fencing along the Rio Grande in an emergency.
The high court provided no explanation for its decision, which is customary in emergency applications. Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh said they would’ve denied the request to toss the lower court injunction while the litigation continues. They also offered no reason for their decision.
The 29-mile fence is part of the escalating fight between the administration and Texas Gov. Greg Abbott (R) over how to manage record high levels of migration along the Southwest border.
Abbott has launched an operation to dispatch state officers to enforce federal immigration laws, which has fueled tension with the administration and resulted in a string of lawsuits.
“Texas’ political stunts, like placing razor wire near the border, simply make it harder and more dangerous for frontline personnel to do their jobs,” said White House Assisant Press Secretary Angelo Frenandez Hernandez in a statement.
Texas Attorney General Ken Paxton said the “fight is not over.” The “destruction of Texas’s border barriers will not help enforce the law or keep American citizens safe,” Paxton said in a statement.
‘Serious Risk’
In the border fencing dispute, the administration told the justices that the limited emergency exception for the Border Patrol posed a “serious risk to human life” because it didn’t give agents enough time to respond to medical emergencies, and that one woman and two children had drowned on Jan. 12.
It is impossible to say what might have happened if Border Patrol had had its former access to the area—including through its surveillance trucks that assisted in monitoring the area.
At the very least, however, Border Patrol would have had the opportunity to take any available steps to fulfill its responsibilities and assist its counterparts in the Mexican government with undertaking the rescue mission.
The government told the court on Jan. 15.
Mexican officials also confirmed to the Border Patrol that they had rescued two migrants who were suffering from hypothermia, Solicitor General Elizabeth Prelogar said in a supplemental memo to the court.
Texas told the court that any loss of life in the Rio Grand is tragic and preventable, which is one reason the fencing was put up. The state said it serves as a deterrent against “those who seek to ford the river and instead routes them to safe, lawful ports of entry.”

The fight over the razor wire fence Texas built along the riverbank is still playing out at the Fifth Circuit. The appeals court has scheduled argument for Feb. 7 to decide if Texas can stop the Border Patrol from cutting or destroying their barrier.
The Supreme Court has recently sided with the administration’s authority to manage immigration.
In June, the justices ruled 8-1 against Texas in its lawsuit challenging the US guidance instructing federal immigration agents to focus resources on undocumented immigrants who have committed crimes.
Texas is also facing a legal challenge from the administration over its recently signed law, set to take effect this March, that would make it a state crime to cross the border illegally.
Congressional lawmakers have recently engaged in border security negotiations, as House Republicans have sought to tie the issue to foreign aid for Ukraine.

Of course, this is not shocking at this point. The Supreme Court is just a bunch of paid-off lawbreakers who violate the law, truth, liberty and justice on a very routine basis.
This country requires cheap labor, and therefore nothing will impede that; as they steal jobs, got subsidized benefits and tax breaks, and so much more.
As I have pointed out many times before, this is a curse God sends on a nation that rejects him and turned away from the truth. This is why the flow of illegal immigrants has been seemingly uncontested for such a long time, and it continues to get so insanely out of control.
