Gay Community News (GCN) reports that the Supreme Federal Court (STF) voted 9-1 August 22th, decreeing ‘homophobia’ as a punishable offence.
Article 20 of the updated Brazillian Penal Code states that practizing, inducing, or inciting discrimination “based on race, colour, ethnicity, religion, or national origin” is punishable by 1 to 3 years in jail, including a hefty fine.
Justice Edson Fachin, lead judge on the case, wrote in his ruling that protecting LGBTQ+ citizens under the law was a “constitutional imperative,” Pink News reported.

The court ruled in 2019 that homophobia was a crime, just like racism. But the earlier decision applied to slurs against the LGBTQ+ community as a whole, not attacks on specific individuals.
Rights group ABGLT brought the case to extend the legal protections further. Hate speech is punishable by prison terms of two to five years in Brazil.

Rights groups registered 228 murders of LGBTQ+ people in Brazil in 2022.
The country of 203 million people is the deadliest in the world for trans people, according to the rights group Transgender Europe, with 1,741 murdered from 2008 to 2022.
