Jenile Thames, a resident of San Leandro, filed suit against Mars Inc, the confection company that produces Skittles, seeking class-action status and alleging that people who consume Skittles “are at heightened risk of a host of health effects for which they were unaware stemming from genotoxicity – the ability of a chemical substance to change DNA”.
The civil suit contends that Mars has long known about alleged risks associated with this chemical and, in February 2016, publicly vowed that it would phase out titanium dioxide. After France banned titanium dioxide in 2019, Mars said that it would comply with this regulation, court papers state.

Thames’s lawsuit alleges that Mars “blew smoke” with that promise six years ago, by intimating that the phase-out was just because “consumers today are calling on food manufacturers to use more natural ingredients in their products”.
Incredibly, Defendant even claimed that ‘[a]rtificial colors pose no known risks to human health or safety’. In doing so, Defendant concealed from consumers material information it knew.
Thames’ suit also said
Thames contends that Mars still sells candy in the US that contains titanium dioxide as an additive and is “failing to inform consumers of the implications of consuming the toxin”. (Ingredients lists vary, some saying they might or might not contain titanium dioxide.)
Instead, Defendant relies on the ingredient list which is provided in minuscule print on the back of the Products, the reading of which is made even more challenging by the lack of contrast in color between the font and packaging, as set out below in a manner in which consumers would normally view the product in the store.
Court papers contend
Thames argued that Mars does not appropriately apprise Skittles consumers of this alleged unsafe additive, either before or at the time of purchase – nor did the company tell them that these candies “should otherwise be approached with caution”.
According to the European Food Safety Authority, titanium dioxide is “a pigment commonly used to provide a cloudy effect and white background colour”, and is typically used in candy and baking. In 2021, the authority announced that “titanium dioxide can no longer be considered safe as a food additive”.
A critical element in reaching this conclusion is that we could not exclude genotoxicity concerns after consumption of titanium dioxide particles. After oral ingestion, the absorption of titanium dioxide particles is low, however they can accumulate in the body.

The hypocrisy here is comical. The way this report is written up, per this lawsuit, is made out to be as if Skittles are only “unfit for human consumption.” Nevermind all the other toxic and highly processed candies and products Mars sells, or the other candy companies, and the “big boys” who dominate the store shelves – that have led to three-quarters of a nation to be considered overweight, and over 40% labeled obese!
Recognize that it is true that Skittles are toxic, and you need to avoid them, but also understand this is also a cloak & dagger to gives the effect that all this other toxic crap is okay.

I was so obsessed with those candies before, but now I am not attracted to them. If I really want something sweet, I’d rather have something fresh that has fresh cream in it for example, or dark chocolate.
I’m on board with you, Cynthia. I quit eating skittles and starbursts they’re just fake colored pieces of artificial fruit sugar that lead to obesity and diabetes.
Except unfortunately, I hate chocolate!

I find that these verses help a lot when I get the craving to buy chips or restaurant food that I did not prepare and cook myself (there are supposedly organic chips in a few of the grocery stores here but I still have my doubts if they are truly organic and pesticide-free. Plus they fry most of them in high heat, yielding acrylamide, harmful for us. Restaurant food here mostly use canola oil, a known inflammatory cooking oil.)

Hello Neil, I just wanted to let you know that your suspicions are for good reason. My husband works in the produce department for a grocery store chain in the Southeastern States. His position has required training of produce that they receive to put out for the customers. In this training, he learned that “USDA Organic” means that the grower uses pesticides that the USDA approves of…..can you say “Monsanto”? (The training does not say this, but come on, we all know who’s money in the back pockets of all of the alphabet soup agencies.)
He has worked in the produce department of this grocery chain for 4 years. 2 different States and 11 different stores. He says that since the day he started until now, every time he opens a “USDA Organic” box of apples, he begins to sneeze uncontrollably. (He has no allergies, nor ever has.) He says he has never had this happen when opening the non-organic apples. (Although, those are so full of GMO it’s ridiculous! He just sent me a picture of the batch of Honey Crisp Apples they got in this morning. The apple is bigger than his entire hand! Franken-fruit!)
We bought veges from an organic farm when we lived in Florida. Upon our first visit, the farmer there took us out to show us the crops. He grabbed veges from different places and showed us the chew marks from the bugs, which was on everything he showed us. He said, “See that? Now THAT’S organic. That stuff they are selling in the grocery stores doesn’t have chew marks from bugs, does it? Know why? It ain’t pretty enough for people to buy. If you don’t see chew marks, it ain’t organic!”

Titanium Dioxide is also used heavily in peppermint candies. Supposedly, it is used to make the white part of the candy very white. My husband works in a grocery store and is around customers at least 9 hours a day and does not want to have offensive breath. He is not allowed to chew gum (if he were, I would send him with Pur gum,) so he prefers peppermint candy. I have been paying almost double for brands that do not use titanium dioxide or have bioengineered ingredients for years.
