The following is a press release from the Department of Health and Human Services (HHS):

Today, the U.S. Department of Health and Human Services (HHS) announced new guidance and communication to ensure all patients — including pregnant women and others experiencing pregnancy loss — have access to the full rights and protections for emergency medical care afforded under the law. This announcement follows President Biden’s executive order on reproductive health issued Friday.

Biden Signs Executive Order To Protect Abortion Access

HHS, through the Centers for Medicare & Medicaid Services (CMS), issued clarifying guidance on the Emergency Medical Treatment and Active Labor Act (EMTALA) and reaffirmed that it protects providers when offering legally-mandated, life- or health-saving abortion services in emergency situations. In addition to the guidance, Secretary Xavier Becerra, in a letter to providers, made clear that this federal law preempts state law restricting access to abortion in emergency situations.

Under the law, no matter where you live, women have the right to emergency care — including abortion care.

Today, in no uncertain terms, we are reinforcing that we expect providers to continue offering these services, and that federal law preempts state abortion bans when needed for emergency care. Protecting both patients and providers is a top priority, particularly in this moment.

Health care must be between a patient and their doctor, not a politician. We will continue to leverage all available resources at HHS to make sure women can access the life-saving care they need.

HHS Secretary Xavier Becerra said

Everyone should have access to the health care they need — especially in an emergency. Under federal law, providers in emergency situations are required to provide stabilizing care to someone with an emergency medical condition, including abortion care if necessary, regardless of the state where they live. CMS will do everything within our authority to ensure that patients get the care they need.

CMS Administrator Chiquita Brooks-LaSure said

The EMTALA statute requires that Medicare hospitals provide all patients an appropriate medical screening, examination, stabilizing treatment, and transfer, if necessary, irrespective of any state laws or mandates that apply to specific procedures. Stabilizing treatment could include medical and/or surgical interventions, including abortion. If a state law prohibits abortion and does not include an exception for the health or life of the pregnant person — or draws the exception more narrowly than EMTALA’s emergency medical condition definition — that state law is preempted.

I imagine individual states and circuit courts will probably seek to immediately rule against this measure by the Biden administration.

  • It’s an “emergency” because they won’t be able to create their death shots. Though, they have plenty of 5G connection micro components and graphene oxide within them.

    This country is finished and I’m thankful for the planned pandemic pre-inoculation genocide because it was a rebuke and a call to repentance for me. I’m still struggling, but I have a desire for righteous standards and righteous indignation.

  • First the ’emergency’ they exploited was terrorism. Same gameplan with ‘medical emergency’. More reasons to get out of healthcare. This is going to make it more miserable than it already is with all the other ‘entitled’, can’t-refuse-care riders who’ve been exploiting the system that exploits them to expand debt & transfer capital; the lower end just because they can& already have chips on their shoulders due the ‘special problems’ which put them on the ‘special’ lists to begin with in just enough cases to make things miserable for everyone. The same type who were increasingly making providers & fellow patients miserable as their leashes were let out, well before 2020….along with the pharma & protocol changes destroying anything good, descent or honest remaining in those professions.

    This creates another class of you-can’t-please-me, and I’m-going-to-do-every-nasty-little-thing-I-can-to-make-your-life-miserable-no-matter-how-much-you-kiss-my-butt tiki god/goddess type. The purposely dumbed down, demoralized kind easily steered into rioting, looting & doing all manner of dumb & wicked stuff.

    Creating crisis, friction and distraction from what’s really going on. God is still in control, & at some point they’re going to lose control & ‘the bottom’ will pay first, but then the ‘upper management’ & top will begin to suffer along with all the rest, too.

    Heard a good study on Isaiah 23 this week. It’s about the judgment on Tyre, which has some endtime parallels & fulfillment yet to come, comparing passages like this, & Ezekiel 28, Revelation 18 KJB. But the pertinent thing was concerning history, and Assyria’s part in it….found in Isaiah 23:13 & the significance underlined as you compare scripture with scripture, & ancient history.

    Assyria was brutal, and they used social engineering tactics. They would relocate conquered people to keep them off-balance & weakened. I knew that, but I never really noted this detail of Isaiah 23:13 before. Assyria relocated & centralized the very people of Babylon which then later took them down under Nebuchadnezzar! After God significantly weakened them & their army when they went against Jerusalem & Hezekiah. The accounts of that are in 2 Kings 18-19 (compare with Revelation 18-19!); and 2 Chronicles 32.

    God delivered Jerusalem from the Assyrians with a great miracle, but not from the Babylonians later. Her shepherds had led her into gross idolatry & iniquity & she’d become a harlot by then….but there was a remnant even then, & they never stopped serving God, nor God blessing them even in their trials & sufferings, even in captivity.     There is guidance, wisdom and hope there for God’s people in the way things are shaping up today.

    We must find time in the midst of our preparations & all the busyness of life to continue in the word & in prayer. Reading the word, but also taking the time to truly & deeply studying, seeing how it fits into world history etc so that God can quicken it to our understanding, & bless us thereby.

    Checking in with James Battell, & his beginning study on Psalms was also a blessing. He gave such a flurry of scripture, & so quickly cross-referencing that I had to listen twice to take notes, and one of the points he made was that we can make application as we read the scriptures in four ways: historically, doctrinally, prophetically, & spiritually. The spiritually one is that with which we must be most cautious, of course. But very often as we read a passage with that in mind, meditating upon it, cross-referencing etc….we find applications in more than one, or even all four in a passage, and it is such a blessing enriching our understanding & inner lives, our walk, & our interactions with people who need to hear, who are learning, or needing encouragement, edification, exhortation etc.

    A few days of light sickness & down time here proved not to be as fruitless as I was at first tempted to think! Even while the wicked keep doing what the wicked do, and as foretold.
