A bill called the “Dietary Supplement Listing Act of 2022” was introduced Tuesday in the U.S. Senate.

Backed by Sens. Dick Durbin (D-Ill.) and Mike Braun (R-Ind.), S.4090 would require manufacturers of dietary supplements list their products with FDA.

Some of the required disclosures to FDA would include:

  • the proprietary name of the product and a statement of identity;
  • electronic copies of dietary supplement product labels; and
  • a list of the ingredients in the dietary supplement required to appear on the label under federal regulations, including, for example, the amount per serving of each listed ingredient, conditions of use, warnings and precautions, and statements concerning major food allergens.

FDA, which has supported mandatory product listing in previous budget requests to Congress, has said the U.S. market contains as many as 80,000 dietary supplement products. Mandatory listing, an FDA spokesperson said Tuesday, “would allow the FDA to know when new products are introduced, quickly identify illegal products, improve transparency and promote risk-based regulation.”

The bill also imposes obligations on FDA, which would be directed to maintain an electronic database populated with product-specific information within two years of creating “a unique dietary supplement identifier system” for use by manufacturers. The public could search the database, based on the dietary supplement’s specific identifier or other information.

The bill would earmark $4 million for FY22 and $1 million in each of fiscal years 2023 through 2026 for FDA to maintain the database.

The listing requirements would not take effect immediately. Rather, within 18 months following the bill’s enactment into law, manufacturers selling products in interstate commerce would have 60 days to list information with FDA. After the 18-month period, manufacturers would need to submit information to FDA before introducing any new dietary supplement products into the U.S. market.

Manufacturers also would need to list reformulated products with FDA, based on the criteria specified in the bill, notify the agency within 90 days of discontinuing marketing of a dietary supplement product and keep certain records. 

Failure to list a product with FDA, if required, would render the dietary supplement “misbranded” under federal law.

Responsible dietary supplement manufacturers should welcome this because the people who are abusing the market and endangering consumers are giving them a bad name.

Durbin said Tuesday in a speech commenting on his bill.

He described his bill as a “common-sense, bipartisan compromise that will protect consumers’ health and save lives.”

As long as that dietary supplement is not dangerous to you or to Americans, as long as we know that it’s for sale, who made it, what’s in it, I think that basic information is what the government should gather. The vast majority of these supplements will not harm people, and the dietary supplement manufacturers know that, and that’s why they’re supporting our effort.

Durbin said

As expected, industry trade associations had mixed reactions to the Dietary Supplement Listing Act of 2022.

Steve Mister, president and CEO of the Council for Responsible Nutrition (CRN), expressed his support for the bill in an April 26 letter to Durbin and Braun.

This legislation will provide FDA and consumers a more complete understanding of the marketplace and the range of products and ingredients currently marketed as dietary supplements. In addition, this new registry should assist FDA in taking enforcement actions against irresponsible companies marketing products as dietary supplements inappropriately.

Mister wrote

On the other hand, the American Herbal Products Association (AHPA) criticized the bill. Neither FDA nor others who support mandatory product listing “have clearly articulated the need for this premarket product listing requirement,” AHPA President Michael McGuffin said in a statement.

In addition, the legislation introduced by Senators Durbin and Braun would create unnecessary, significant and redundant burdens on industry.

The supplement industry has been on fire and one of the fastest growing industries in recent years, as there are not a whole lot of restrictions in that space – which will dissipate, assuming this bill passes. At one point last year I was considering entering into this space as well, offering high-quality, organic, supplements to help with a spectrum of health issues. But I did not have enough capitol to feel comfortable doing it, and it would greatly hinder my time writing for The WP.

That being said, what so many supplement companies do is they create a certain kind of proprietary blend of ingredients, which allows the manufacturer to not legally disclose the actual dosages of certain ingredients. Many companies do a lot of “label packing:” they put scores of ingredients on the label to deceive the consumer into thinking they are getting a slew of health benefits, when in reality most companies sprinkle some dust of a dozen different ingredients in there, which do nothing, but make the product more hyped up and allows for a higher price point. Most consumers get bamboozled into buying junk supplements all the time.

This bill eliminates that, which will hurt some companies, yes, but I honestly think that most consumers still won’t understand what they are reading, and will still buy these junk and over-hyped supplements.

That being said, this report also notes how the government is further mitigating and tracking the movements of goods and foods even more, which means even less freedom of business in this crony-capitalistic and fascist economy.

  • Of course they are…. True to pattern of cutting off any escape routes from their tyranny of suffering & debilitating and killing initiations & sortings. In the meantime, I have cancer & have used the supplementation strategy for some time, helping with navigating covid manipulations as well….but have been working to source as much as possible from diet, whether foraged or home-grown.

    Sulfurous foods like the onion & garlic family, and the cruciferous /cabbage are good NAC precursors. Add in Epsom salts baths and good, balanced animal fats with grass-fed Omega 3 and it’s an aid in the war against life & liberty until Jesus comes, or until & if the ultimate sacrifice of faith is required. These bodies of corruption & flesh are called tabernacles for a reason: and though we are to nourish them as tools & shelter to the service of God, & with thanksgiving: that soul & spirit within take precedence.

    Stephanie Seneff has some helpful information there, and Dr. Lee Vliet….but neither are Christians in the biblical sense. Mercola has gone over to subscription only access which tells me he’s into the selling of personal data….and I am distancing myself from there, & from his supplements as able & replacing them.

    One thing duly noted is that the most helpful nutrients & supplements in the war for good health address the same overlapping symptoms of the usual suspects of biological biowarfare & vaccination (intended & non- damages), EMF and radioactivity damage, and glyphosate/genetic modification issues: either direct as with the vaccine infection, or through foods & general pollution.

    Dr. Vliet also laid side by side the symptoms of so-called covid, emf radiation poisoning, and even the new boogie man, Marburg disease…and showed that no matter what they call it, the symptoms are the same: including coronary & arterial blockages, blood changes etc. I would add Seneff’s observations of symptoms of glyphosate & gmo; and even the wasting & face-biting thing of the ‘zombie apocalypse’ drug fad, which is likely connected as well, probably through gmo manipulation in foods & regular vaccines even before the ‘big one’, given that our government has an ‘action plan’ relating to that.

    I remember thinking how odd that was when folks were talking about the zombie apocalypse play-acting & reality show type ‘survivor’ games that their sorority & fraternity college students were involved in. I still thought that professional occupational programs were still kosher, & those things weren’t involved there….but it’s all caste programming and conditioning for elites, serf/slaves and managers, and must be carefully navigated with only the most mature & biblically grounded surviving it: even to certification in plumbing, construction and such things; not to mention the restructured & ‘transformed’ health industry which used to be preferred by Christians wanting to minister in a ‘helps’ type of capacity, & was therefore duly targeted & attacked by the transformers.

    Prior to that they were ‘sensitizing’ such to ‘gay rights’ by having young, immature & inexperienced Christian background students spending an evening in a gay bar or such thing for credit. I personally knew a young lady who was slipped drugs, seduced & raped, traumatized psychologically & physically to the point of suicide by such a program at the old Quaker school of Muskingum College (there was also active drug recruitment of students there) back in the ’90’s.

    Feminist activists involved in counseling (think the darkness of the confessional, and all parties involved not being involved in the light in the ‘discussion’…..pre-social media manipulation of the same type, new level) were also counseling young ladies chafing at home restrictions to make false accusations of sexual molestation & abuse in order to get out of the home & into foster care or group teen homes…where further conditioning took place, as well as continued & ramped up psych-medication opening people to devils through debilitating reason & desensitization in an organized & purposeful attack. Personal experience. Again, in the ’90’s.

    None of this sprang from a vacuum, and 60 to 70 years of liberal public ed, and 20 or so years of transitioning people from the power & rock of the King James Bible to the antichrist spirit & shifting sand of the perversions was all it took. Look where we’re at now.
    But it was all covered up and not discussed, & folks would not listen or believe such things were going on.

    • @kddlporter I don’t mean to be all up in your biz, but have you gotten to the root cause of your cancer if you don’t mind me inquiring? How long have you had it? Have you tried prolonged water fasting for autophagy/mitophagy? (you mentioned earlier that cancer is a mitochondrial problem)

  • I would recommend stocking up. Of course, in the current climate, that is a good idea for everything. You can also look for alternatives sources. You can use Borax for boron, Pines needles for vitamin C, etc… Also, I get some of my supplies from Tractor supply to save money (DMSO, salt, Magnesium Chloride). You need to get creative, learning basic chemistry is so useful in life.
