Not long after Biden’s updated vaccine mandate for even more U.S businesses with over 100 employees – that is set to go into full effect starting January 4th – federal appeals court ordered a stay of the mandate.
The court cited “grave statutory and constitutional” issues with the ruling.
The Court of Appeals for the Fifth Circuit based in New Orleans made the ruling after many Republican-ran states gave stark opposition to these mandates.
The Occupational Safety and Health Act explicitly gives OSHA the authority to act quickly in an emergency where the agency finds that workers are subjected to a grave danger and a new standard is necessary to protect them. We are fully prepared to defend this standard in court.
Solicitor of Labor Seema Nanda, who explained that the Labor Department was “confident in its legal authority” to enforce that edict.

As for the legal side of this, let me be crystal clear to avoid what appears to be possible misinformation or disinformation around the emergency temporary standard being a vaccine mandate. That would be on its face incorrect as has been explicit for months. It is a standard for safe workplace to either comply with weekly testing or to be vaccinated.

‘Saturday’s court order came in response to a joint petition from several businesses, advocacy groups, and the states of Texas, Louisiana, Mississippi, South Carolina and Utah. The rule is also facing separate legal challenges before other courts,’ says Reuters.
This order from the court orders the Biden Administration to make a response to the request ‘for a permanent injunction against the rule by 5 p.m. Monday,’ November 8th.

It’ll be interesting to see how this plays out. Either some of these states will win, or the draconian mandate continues forth. Being my pessimistic-self, I tend to think it will get shot down somehow. On the flipside, however, maybe these elites who pull the strings behind closed doors don’t want a full-blown collapse at that time. Lord only knows, but I mention that because the courts are so corrupt as with all the rest of the government, so more scheming may be at work.
