BRASHER FALLS, N.Y. — Authorities in New York state have charged a 7-year-old boy with third-degree rape, multiple news outlets are reporting.
According to WWNY-TV and the Watertown Daily Times, New York State Police last week charged the Brasher Falls boy in connection with an incident that occurred in November 2020. The department confirmed the child’s age to the Daily Times.
Police cited the boy before releasing him, WWNY reported.
Attorney Anthony Martone, the director of Queens Defenders’ felony youth defense unit, told WWNY that the charge is “absurd.”
“I don’t think you even could really realize what you’re doing at 7 years old,” he told the news station.
Instinctually, it shouldn’t happen to a 7-year-old. I don’t think you could even realize what you’re doing at 7 years old, so I think it’s absurd to charge a 7-year-old with rape. They’d have to prove he actually physically committed this act, which to me, it almost seems to be an impossibility.

In New York state, a child must be 7 or older to face juvenile charges, though lawmakers are considering legislation that would raise the minimum age, WWNY reported.
According to newyorkcriminallawyer24-7.com, here is what is defined as third-degree rape in New York:
New York Penal Code § 130.25 states that third degree rape exists if a person committed any of the following:
- Had sexual intercourse with a person who is not able to give consent,
- Had sexual intercourse with a person who is younger than 17 years of age when the person is 21 years of age or older, or
- Had sexual intercourse with a person who did not give consent to the act.
Even if the person appeared to have given consent, if that person is not legally able to give consent, then one could infer that there was no consent, and a charge of third degree rape would be levied. Further, by law, a person who is younger than 17 years of age and is mentally disabled, mentally incapacitated, or physically helpless is not able to give consent. Finally, if a person had not given consent to sexual intercourse, then the legal inference would be that the act was forced on the non-consenting person.
Hypothetical Case:
Suppose a 30-year-old man meets a 16-year-old teenage girl at a mutual friend’s party. The two have sexual intercourse that same evening, continue their intimate relationship after the party and engage in sexual intercourse on a regular basis. Even though the adult man did not appear to have forced the under-aged teenage girl to engage in sex with him, he still could be accused of committing third degree rape because the girl was under 17 years of age and legally unable to give her consent to the sex act.

Based on the multiple reports I read, none of them went into real good depth. From what I can tell, this was not just some peck on the cheek and this is not being overblown: it sounds like this boy really did in fact try to have intercourse presumably with someone of similar age.
I do not know for sure, and I could be totally wrong. I’d like to think is being total overblown, but in this world, I wouldn’t put it past this boy to do that.
I am mentioning this because it demonstrates just how far and perverted this nation has become and has been for some time, which will only get worse (2 Timothy 3:13). The children today are being blasted with never ending programming to accept sodomy and the LGTBQ+ lifestyle, that fornication and dishonoring your body is normal and acceptable, and basically every form of lasciviousness the brain can conceive.
Even as Sodom and Gomorrha, and the cities about them in like manner, giving themselves over to fornication, and going after strange flesh, are set forth for an example, suffering the vengeance of eternal fire.

Whatever happened, if it was a seven year old: the child was abused & conditioned into perversion by adult/s. It’s not normal for a seven year old to have such thoughts at all beyond curiosity about differing ‘parts’, & not even sure it’s physically possible. We’re talking first grader, second grader max. My “brother” was a porn addict for a long time and did grievous actions, and in his childhood, best friends with another who may have also introduced him to porn because that kid ended up committing sexual crimes against his sister. It makes me wonder if my “brother” also did those actions to the guys’ sister since the three of them were always together speaking and laughing about doing stuff that I was too young to understand and couldn’t go along.

I couldn’t care less what that hypothetical case says, a 30 year old man or woman with a 16 year old is just downright sick! Marry and date your own age!
A 7 year old being charged with rape? How is that even possible?!?!?! A child that age isn’t even strong enough to force themselves on anyone nor do they even know what that is, they haven’t even learned about the birds and the bees yet!
